These Terms and Conditions (“Terms”) govern your access to and use of betterpros.com and any related services offered by BetterPros (“we,” “us,” or “our”). By accessing or using our website, you agree to be bound by these Terms in full. If you do not agree, please discontinue use immediately.

1. Scope and Purpose

These Terms and Conditions govern the participation of individuals (“Candidates”) in the recruitment and selection processes conducted by BetterPros LLC (“BetterPros”).
These Terms apply solely to the pre-contractual stage of interviews, evaluations, communications, and related recruiting activities.

2. No Employment or Contractual Relationship

Participation in BetterPros’ recruitment process:

  • does not create an employment relationship,
  • does not create a professional services relationship,
  • does not create any contractual, agency, partnership, or joint venture relationship between the Candidate and BetterPros or any BetterPros client.

Any professional, commercial, or contractual relationship will arise only upon execution of a separate written agreement signed by the relevant parties.

3. Confidentiality During the Recruitment Process

Candidates may receive or be exposed to confidential or proprietary information belonging to BetterPros or its clients, including but not limited to business processes, pricing, technical information, client identities, or project details (“Confidential Information”).

Candidates agree to:

  • use Confidential Information solely for purposes of the recruitment process;
  • not disclose Confidential Information to any third party; and
  • not use confidential information for personal or competitive advantage.

This obligation survives the end of the recruitment process.

4. Data Protection and Information Security

4.1 Collection and Use of Data
Candidates acknowledge that BetterPros may collect, store, and process personal data provided during the recruitment process for evaluation, compliance, and communication purposes.

4.2 Security Measures

Candidates agree to:

  • use secure devices when accessing BetterPros systems or materials;
  • not use shared, public, or unsecured computers for recruiting-related communications;
  • maintain reasonable password hygiene and access controls; and
  • promptly notify BetterPros of any suspected data breach or unauthorized access.

 

4.3 No Guarantee of Security

While BetterPros implements reasonable administrative, technical, and organizational safeguards, no system can guarantee absolute security. Candidates acknowledge and accept this risk.

4.4 Data Retention and Deletion

Upon conclusion of the recruitment process, BetterPros may retain candidate information as required by law or for legitimate business purposes, subject to applicable data protection regulations.

4.5 Use of Image and Audiovisual Content

The Candidate authorizes BetterPros to use and share any video recordings provided during the recruitment process for evaluation and presentation to clients in connection with potential professional opportunities, without time limitation, compensation, or approval rights.

5. No Obligation to Engage

BetterPros is under no obligation to:

  • make an offer to any Candidate,
  • proceed with any interview or evaluation, or
  • provide feedback or explanations regarding recruiting decisions.

Candidates are likewise under no obligation to accept any future offer.

6. No Circumvention

Candidates agree not to use information obtained through the recruitment process to directly solicit or engage BetterPros clients or business partners outside of BetterPros’ formal engagement channels.

7. Limitation of Liability

To the maximum extent permitted by law, BetterPros shall not be liable for:

indirect, incidental, consequential, or special damages arising from participation in the recruitment process;
loss of opportunity, income, or expectations; or
decisions made by Candidates based on recruiting communications.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

9. Acceptance

By submitting an application, participating in interviews, or engaging in communications with BetterPros, the Candidate acknowledges having read, understood, and accepted these Terms.
